Holyoke Community College Class Promises Happier New Year

HOLYOKE — Past year got you down? Need a brighter outlook for 2021? Holyoke Community College has a class for you.

HCC is partnering with Pam Victor, president and founder of Happier Valley Comedy, to offer a Zoom workshop titled “Establishing Resilience: Building Happiness” on Saturday, Feb. 6 from 11 a.m. to 1:30 p.m.

Victor, a comedian and improv facilitator who prefers the title ‘head of happiness,’ will lead participants on an experiential exploration of happiness and resilience building to enhance their joy and ease at work and home. She will share stress-relieving exercises and techniques to help people bring more well-being, laughter, gratitude, and play into their daily lives.

“Finding more joy in 2021 is a priority for me,” said Michele Cabral, HCC’s executive director of Business, Corporate and Professional Development. “As a participant in Pam’s 30-day ‘Happiness Experiment,’ I can tell you without doubt that this class is for everyone. In this single session, participants will get an introduction into the full program while Pam shares many useful tips and resources to help people get an uplifting start to the new year.”

Grants Will Provide 100,000 Meals for People Across Western Mass.

HATFIELD — Wheeler & Taylor Insurance of Great Barrington and Canary Blomstrom Insurance Agency of Agawam are providing major support to the Food Bank of Western Massachusetts. Two rounds of funding, one now and a second round in the spring, will pay for about 100,000 meals. The Food Bank provides food to 165 food pantries, shelters, and meal sites in Berkshire, Franklin, Hampden, and Hampshire counties.

“We’re so grateful to Wheeler & Taylor and Canary Blomstrom for their social investment in the Food Bank’s mission to feed our neighbors in need at this critical moment,” Executive Director Andrew Morehouse said. “With this support, overall, we’ll be able to provide 100,000 meals to households struggling to make ends meet and put healthy food on the table.”

Added Wheeler & Taylor Insurance president J. Scott Rote, “thanks to the Food Bank, thousands of people in the region are able to get enough to eat every day. In this time of unprecedented need, our communities need unprecedented support, and we’re glad to do our part.”

Wheeler & Taylor and Canary Blomstrom are members of GoodWorks Financial Group, a network of common-ownership insurance, real-estate, and financial firms.

“It couldn’t be a worse year, a more heartbreaking year, for many folks,” said Sandy Brodeur, president of Canary Blomstrom. “I’m glad to know the grants will support food programs in our local area as well as regionally.”

With the pandemic, demand for food has grown exponentially. The Food Bank is serving 109,500 people a month in 2020, up 16% from 2019. The organization distributed 11.1 million pounds of food from March through October, a 30% increase. It estimates that about one in six residents in the region, including 40,000 children, or one in four, are food-insecure.

In the face of a whirlwind presidential campaign and massive fundraising numbers coming out of marquee U.S. Senate contests, it’s easy to overlook what’s happening in the race for the U.S. House of Representatives. That might be because Democrats look like strong bets to hold onto power there. In fact, FiveThirtyEight’s forecast is most confident about the House, as the Deluxe version of our model gives Democrats a 95 in 100 shot at retaining control of the House, better than Joe Biden’s 88 in 100 chance of winning the presidency or the Democrats’ 74 in 100 chance of capturing the Senate.The Senate numbers are based on the Deluxe version of the model, which is the default version of our congressional forecasts this year.

However, even if Democrats do hold onto the House, that doesn’t mean they’ll retain every seat they control. In fact, there are a number of seats they might lose, including that of Minnesota Rep. Collin Peterson, the most vulnerable House incumbent seeking reelection in 2020. The Deluxe version of our House forecast only gives him about a 1 in 4 shot of winning in Minnesota’s 7th Congressional District against Republican Michelle Fischbach.

Peterson’s chances come down partly to the makeup of his rural district in western Minnesota. The 7th Congressional District is 26 points more Republican than the country as a whole, according to FiveThirtyEight’s partisan lean metric,Partisan lean is the average difference between how a state or district votes and how the country votes overall, with 2016 presidential election results weighted 50 percent, 2012 presidential election results weighted 25 percent and results from elections for the state legislature weighted 25 percent.

making it the most GOP-leaning House seat held by a Democrat. Seeking his 16th term in office, Peterson has won past elections as a Democrat thanks to his moderate views, his anti-abortion stance and his focus on agricultural issues. And as the chair of the House Agriculture Committee, he’s been very attentive to farming interests, especially the sugar beet industry, which is important to his constituency. Still, the rightward shift in his district in the last decade or so narrowed his margin of victory to about 4 points in 2018.

But beyond the seat’s increasingly deep red hue, Peterson is up against his most daunting challenger in years. Fischbach served as the state’s lieutenant governor and, before that, as president of the Minnesota Senate. And unlike recent Peterson opponents, Fischbach has nearly matched his fundraising. On top of that, Republican groups have spent $ 5 million on her behalf, while Peterson has received a little less than $ 4 million in outside support. It’s no wonder then that the expert handicappers at The Cook Political Report, Inside Elections and Sabato’s Crystal Ball all rate this race as a toss-up, which factors into the Deluxe version of our forecast.

However, despite Peterson’s trying circumstances, the good news for Democrats is that his vulnerability makes him a rare bird in 2020. Of the most endangered Democratic-held House seats, Democrats are clear underdogs in just Peterson’s district. In fact, as the table below shows, Democrats are slightly favored in most competitive seats they are defending (races where they have less than a 3 in 4 shot of winning). Just two other Democratic incumbents face toss-up races: Rep. Kendra Horn in Oklahoma’s 5th Congressional District and Rep. TJ Cox in California’s 21st Congressional District.

Horn’s race is particularly close, as the district is still heavily red (13 points more Republican than the country as a whole) and she won in 2018 by just 1 point. Meanwhile, Cox is defending more Democratic-leaning turf, but he’s faced scrutiny over owing back taxes and is running against former Republican Rep. David Valadao, whom Cox edged out by a slim margin in 2018 (less than 1 point). And in California’s top-two primary system back in March, Cox trailed Valadao by 11 points, which could be a poor harbinger for the freshman incumbent.

These three seats, plus the others where Democrats are marginally favored, could be especially vulnerable if things go better for Trump than currently expected. Nevertheless, Democrats are helped out by the fact that they have incumbents running in all but one of these seats, and 12 are freshmen incumbents who have raised huge sums of money.

By comparison, Republicans find themselves defending far more vulnerable seats than Democrats despite controlling fewer seats overall. This is mostly thanks to redistricting, retirements and the Democratic-leaning electoral environment. As the table below shows, GOP candidates are underdogs in three Republican-held seats, roughly 50–50 in nine others and have less than a 3 in 4 shot of winning in 13 more.

Two North Carolina seats are almost surefire Democratic pickups due to court-ordered redistricting, while retiring Rep. Will Hurd’s seat in Texas’s 23rd Congressional District is leaning toward the Democrats, too. Retirements and primary losses have left five of the nine GOP toss-up seats open, which helps Democrats even if the incumbency advantage isn’t what it once was. Lastly, the 13 seats that lean toward Republicans are all seats that could conceivably flip toward Democrats if 2020 is another “blue wave” election.

Put it all together and you can see why the Democrats’ chances of holding onto the House look pretty good, even if they do have the most endangered incumbent up in 2020.

Medicare The Most Lifestyle USA Drug Pricing Rules: Advanced Lawsuits

On September 13, 2020, President Trump issued an Executive Order (the “Executive Order”) directing the Department of Health and Human Services (“HHS”) to issue regulations instituting two most-favored-nations (“MFN”) payment models — one model for prescription drugs covered by Part B of the Medicare program (in general terms, Medicare Part B covers drugs that are administered by infusion or injection in physician offices and hospital outpatient departments, as well as certain drugs furnished by suppliers), and a second model for prescription drugs covered by Part D of the Medicare program (Medicare Part D covers most medications that are dispensed by local and/or mail-order pharmacies and covered under a Medicare prescription drug plan).
The Executive Order is part of the Trump Administration’s efforts to lower prescription drug prices for American consumers. According to the Executive Order, “Americans pay more per capita for prescription drugs than residents of any other developed country in the world.” In this way, the Executive Order concludes that Americans are, “effectively subsidizing innovation and lower-cost drugs for the rest of the world.”
On November 27, 2020, the Centers for Medicare and Medicaid Services (“CMS”) published an Interim Final Rule with Comment Period (“Final Rule”) implementing a MFN model for the reimbursement of Medicare Part B drugs (the “MFN Model”) — a modification of a drug payment model originally proposed by CMS in an Advance Notice of Proposed Rulemaking (“ANPRM”) dated October 30, 2018. Although the Executive Order directs HHS to issue regulations for a Medicare Part B MFN model and a Medicare Part D MFN model, the MFN Model as set forth in the Final Rule only applies to Medicare Part B prescription drugs. As reported by CMS Administrator Seema Verma, CMS is currently in the process of developing a most-favored-nations model for Part D drugs.[1]
Following the directives of the Executive Order, the purpose of the MFN Model is to, “test whether more closely aligning payment for Medicare Part B drugs and biologicals…with international prices and removing incentives to use higher-cost drugs can control unsustainable growth in Medicare Part B spending without adversely affecting quality of care for beneficiaries.” According to the Final Rule, the CMS Innovation Center (the “Innovation Center”) will oversee the implementation of the MFN Model for a seven (7) year performance period (“Performance Period”) starting on January 1, 2021 to assess the MFN Model’s ability to achieve the goals described above.
The comment period for the Final Rule is open until January 26, 2021.
BACKGROUND: RAPID INCREASE IN MEDICARE PART B DRUG SPENDING
According to a CMS Press Release dated November 20, 2020, “Trump Administration Announces Prescription Drug Payment Model to Put American Patients First” (the “CMS Press Release”), Medicare Part B drug spending per enrollee has grown at an annual rate of 8.1% over the last five years — twice as fast as the growth of per capita Medicare Part D drug spending (3.4%) and nearly three times as fast as overall retail prescription per capita drug spending (2.9%). In response to this data, HHS Secretary Alex Azar lays the blame (at least in part) at the feet of the Medicare Part B drug reimbursement methodology and the methodology’s influence on the prescribing behaviors of physicians. As reported in the Press Release, Secretary Azar believes that the current Medicare Part B drug reimbursement methodology must be changed to, “protect current beneficiary access to Medicare Part B drugs, make them more affordable, and address the disparity of drug costs between the U.S. and other countries.”
Some may argue that the growth in Medicare Part B drug spending, as compared to Medicare Part D spending and drug spending nationwide, is more a function of the types of drugs that are covered by Part B — generally more specialty medications including medications that can only be dispensed after being compounded in a compounding pharmacy — as opposed to the peculiarities of the Medicare Part B drug reimbursement methodology. The Press Release and the Executive Order, however, make it clear that the Trump Administration is focusing its attention on changes in reimbursement methodology as opposed to Medicare coverage rules as the proper way to address rising drug costs.
CURRENT MEDICARE PART B DRUG REIMBURSEMENT METHODOLOGY
Currently, Medicare Part B reimburses physicians and outpatient hospitals for most separately payable Part B–covered drugs that they furnish to Medicare beneficiaries at an amount equal to a manufacturer’s average sales price (“ASP”) plus a 6% add-on amount. ASP is defined as the average price realized by a manufacturer for sales to all purchasers (subject to certain exceptions[2]) net of rebates, discounts, and price concessions. In addition to paying 106% of ASP for a Medicare Part B-covered drug, Medicare Part B allows a separate payment for administering the drug to the patient (e.g., for infusing or injecting the product) under the Medicare physician fee schedule or the Medicare hospital outpatient prospective payment system, whichever is applicable based upon the setting in which the drug is administered.[3]
As described above, the current Medicare Part B drug payment methodology requires CMS to reimburse Medicare-treating physicians and providers at 106% of ASP for administered drugs regardless of the actual price of the drug being administered. As a result, CMS is not able to lower Medicare Part B drug prices through negotiations with drug manufacturers. As highlighted in the CMS Press Release, although state Medicaid programs and Medicare Part D plans have tools to reduce certain drug costs through price negotiations, current law does not allow the Medicare Part B program to do the same.
THE MFN MODEL FOR MEDICARE PART B DRUGS
As a way to lower Medicare Part B drug costs and, as described in the Executive Order, “put American patients first” by allowing Medicare Part B beneficiaries to obtain the benefit of the discounted drug prices negotiated by other countries for their own citizens, the MFN Model limits Medicare Part B costs for certain designated drugs to the lowest price that the drug manufacturers receive in other similar countries for the same drug.
As described in the Final Rule, the MFN Model applies to the top 50 separately payable, physician-administered Medicare Part B drugs (“MFN Model Drugs”), which currently account for approximately 73% of Medicare Part B drug spending. The MFN Model payment system includes two parts. First, the MFN Model calculates the payment amount for MFN Model Drugs based on a price that reflects the lowest per capita Gross Domestic Product-adjusted (“GDP-adjusted”) price in any Organization for Economic Co-operation and Development (“OECD”) country with a GDP per capita that is at least 60% of the United States’ GDP per capita, based on existing data from CMS. If the drug is reported in shortage by the FDA or there is no international sales, volume, or pricing information available for a specific drug, the payment amount will default to the previously used ASP.
Second, MFN Model Drugs will be subject to a single alternative add-on payment equal to approximately six percent (6.112%) of 2019 spending for the MFN Model Drugs as a whole, which will be trended forward with an inflationary factor on a quarterly basis. This replaces the six percent (6%) add-on currently used for Medicare Part B drug reimbursement purposes, and aims to remove or reduce the financial incentive to prescribe higher-cost drugs.
While the ANPRM initially sought to implement the MFN Model across half the country as part of a randomized controlled trial, under the Final Rule, CMS has expanded the scope of the MFN Model to be a mandatory nationwide trial program affecting most Medicare providers during the Performance Period. More specifically, participation in the MFN Model applies to the following entities: (1) Medicare-participating physicians and non-physician practitioners; (2) group practices; (3) hospital outpatient departments; (4) ambulatory surgical centers; and (5) other providers and suppliers that receive separate Medicare Part B fee-for-service payment for the Model’s included drugs, such as home health agencies. However, cancer hospitals, children’s hospitals, critical access hospitals, rural health centers, federally qualified health centers, community mental health centers, and Indian Health Service facilities are amongst the entities currently excluded from the Rule.
The MFN Model will be phased in over the first four years of the Performance Period, starting with a hybrid reimbursement model combining the ASP methodology and the MFN Model price. In the first year, reimbursement will consist of 25% of the MFN Model price and 75% of the previous ASP reimbursement. For the next three years, the share of the MFN Model price will increase at a rate of 25% per year. Reimbursement in years four through seven of the Performance Period will be 100% of the MFN price.
The CMS Office of the Actuary (“OA”) estimates the MFN Model will result in savings of $87.8 billion, but admits that “there is much uncertainty around the assumptions” for such estimates.
REACTIONS TO THE FINAL RULE: SUBSTANTIVE AND PROCEDURAL CHALLENGES
As evidenced by multiple lawsuits, damning editorial comments and press releases, to say that the MFN Model has its detractors is a tremendous understatement.
A. Procedural Defects
On December 4, 2020, the Pharmaceutical Research and Manufacturers of America (“PhRMA”), the Association of Community Cancer Centers, the Global Colon Cancer Association and the National Infusion Center Association (collectively, the “MFN Plaintiffs”) filed a lawsuit in the U.S. District Court for the District of Maryland asserting that the Final Rule, including the MFN Model, exceeds the statutory authority provided to CMS, raises serious constitutional questions, and fails to follow required rulemaking procedures as set forth in the Administrative Procedure Act (“APA”). See, Ass’n of Community Cancer Centers v. Azar (D. Md. Dec. 4, 2020) (№1:20-cv-03531) (the “MFN Lawsuit”).
As summarized in a December 4, 2020 PhRMA Press Release, “Statement on Litigation Challenging Legality of the Administration’s Most Favored Nation Rule” (the “PhRMA Press Release”), the MFN Plaintiffs’ allegations center on three key areas:
The Trump Administration has exceeded the authority granted to the Innovation Center under the Affordable Care Act;
The Trump Administration has violated the U.S. Constitution by using a regulatory process to rewrite the Medicare statute and transform the reimbursement system for physician-administered medicines in the United States; and
The Trump Administration has failed to demonstrate the “good cause” required for the Final Rule to skip important notice and comment procedures that allow the American public to weigh in on regulations.

For these reasons, the MFN Plaintiffs seek a preliminary injunction to enjoin the enforcement of the Final Rule and a declaration from the court that the Final Rule is unconstitutional and invalid.
B. Patient Harm: Drug Access and Utilization
As originally described by CMS in the ANPRM, the MFN Model is intended to lower Medicare drug costs without limiting Medicare beneficiary access to drugs. However, in the Final Rule, it seems as if CMS has abandoned its claim that the MFN Model will have its intended results without limiting drug access and utilization
According to the Final Rule, “a portion of the [Medicare] savings [from the MFN Model] is attributable to beneficiaries not accessing their drugs through the Medicare benefit, along with the associated lost utilization.” In other words, if a provider cannot negotiate favorable enough deals with manufacturers to accommodate the reduced MFN Model reimbursement that the provider will receive for dispensing and administering MFN Model-covered drugs, the provider may decline to take the financial risk of acquiring the particular drugs at all, meaning that the provider’s patients may no longer be able to access them. According to the OA, Medicare Part B drug utilization is expected to be reduced by 19% by 2023 due to beneficiaries’ inability to access their drugs through the Medicare benefit under the MFN Model.
In response to the access concerns that have been triggered by the Final Rule and the CMS OA y conclusions, CMS Administrator Verma tweeted, “[a]s for concerns regarding access, I cannot imagine any manufacturer who will withhold access to their drugs from American seniors because we’re simply seeking a fair deal on price.”
In a December 11, 2020 Press Release (the “COA Press Release”) issued by the Clinical Oncology Alliance (“COA”), “Oncologists Sue to Stop ‘Dangerous and Unlawful’ Most Favored Nation Drug Pricing Scheme,” in which COA announced the filing of its own suit against the enforcement of the Final Rule (See, Community Oncology Alliance v. Azar, D. D.C. Dec. 11, 2020 (№1:20-cv-03604)), Ted Okon, COA Executive Director, said that the MFN Model poses a potentially life-threatening risk to a substantial number of seniors. Using CMS’ own OA estimates, the COA Press Release states that, “in the first year of the MFN experiment, 20 percent of seniors will be forced to find new oncologists and treatment elsewhere; however, nearly half of those will “forgo” treatment. By 2023, 30 percent of Medicare seniors may be displaced, with an alarming 1 in 5 seniors not getting treated.” As concluded by Okon, the MFN Model, if implemented, would be a “death sentence for patients with cancer and other serious diseases.”
C. Impact on Medical Innovation
Biopharmaceutical industry participants and watchers have expressed concerns that the international drug price controls within the MFN Model will have a significant and negative impact on biopharmaceutical research and development (“R&D”).
In a November 20, 2020 PhRMA Press Release, Stephen J. Ubl, PhRMA President and CEO stated that, “it defies logic that the administration is blindly proceeding with a ‘most favored nation’ policy that gives foreign governments the upper hand in deciding the value of medicines in the United States. History proves that when governments take unilateral action to set prices, it disrupts patient access to treatments, discourages investment in new medicines and threatens jobs and economic growth. In addition, according to a December 1, 2020 PhRMA blog article, “No matter how you look at it, the Most Favored Nation rule is bad policy.” European countries that implemented MFN Model-like government drug price setting laws in the 1980s and 1990s saw their biopharmaceutical R&D industries migrate to other countries with more pro-innovation policies, principally the United States. According to Ubl, “we’ve seen immense progress with vaccine candidates showing promising clinical trial results and treatments making their way through FDA review. This progress is possible largely because of America’s global leadership in biopharmaceutical R&D. Despite this, the administration is willing to upend the entire system with a reckless attack on the companies working around the clock to end this pandemic.”
In a similar vein, Michelle McMurry-Heath, MD, Biotechnology Innovation Organization (“BIO”) President and CEO, issued a strongly worded statement in a September 13, 2020 BIO Press Release condemning the Trump Administration’s pursuit of MFN Model price controls. “With scientists and researchers at America’s biopharmaceutical companies working around the clock to fight a deadly pandemic, it is simply dumbfounding that the Trump administration would move forward with its threat to import foreign price controls and the inevitable delays to innovation that will follow.”
AND NOW WHAT?
Because the Final Rule will be open for comment until January 26, 2021–60 days following its November 27th publication date — and the new Biden Administration will be in place prior to the closure of the comment period, the Biden Administration will have a short window of opportunity to quickly modify or suspend the Final Rule before the comment period closes. However, absent a temporary restraining order in any of the currently pending lawsuits, providers and others are well advised to prepare for compliance with the Final Rule and the MFN Model effective January 1, 2021.

Unbound Tech unlocks liquidity and security for proven digital asset management

From time to time, we invite industry thought leaders to share their opinions and insights on current technology trends to the IT Infrastructure blog. The opinions in these blogs are their own, and do not necessarily reflect the views of IBM.

There are very few scenarios where security is more important than in the world of digital assets. If the key protecting a digital asset is compromised, then it’s game over.

At the same time, trading digital assets will only enter the mainstream when it’s possible to do it quickly and easily. For financial institutions accustomed to making transactions within a fraction of a second, waiting hours or even days for different keyholders to sign off on a digital asset trade is unthinkable.

At , we saw an opportunity. By combining our unique multiparty computation (MPC) software with the built on , we’re bringing unprecedented liquidity and security to digital asset management.

Sizing up the challenge

Unbound is a pioneer in the use of MPC to secure cryptographic keys from every angle, splitting each key into multiple shares that are never united. By distributing trust, we ensure that a breach of any single machine never compromises the integrity of a key.

In the cryptographic world, there’s no such thing as “too secure.” However, we recognized that existing enterprise-class digital asset management solutions are forcing customers to choose between security and agility. What use is the most secure platform in the world if it’s unusable in real life?

We set out to build a new offering that pushes the boundaries of security without limiting liquidity of digital assets.

Creating the Unbound Crypto Asset Security Platform (CASP)

Developed with help from IBM, the Unbound Crypto Asset Security Platform (CASP) solution introduces lucrative benefits for digital assets service providers, including:

  • The elimination of any single point of failure across the full digital asset lifecycle. IBM LinuxONE infrastructure offers unique resiliency features such as triple-redundant environmental sensors and Redundant Array of Independent Memory (RAIM) to keep applications running even in the unlikely event of a component failure. IBM LinuxONE , with the mean time between failures (MTBF) measured in decades(!).
  • Strict policy enforcement and cryptographic signing support across nearly unlimited asset types (no need for programming multi-sig, smart contracts).
  • Insider-resistant, hardened infrastructure for Unbound CASP’s critical software elements. CASP services, key management, vaults, databases, chain connectors, and server-side bots all run within , which are securely booted, protected memory enclaves. These enclaves help assure that administrators and operators do not have even technical access to the applications managing digital assets, such as policy enforcement mechanisms. For example, if an administrator initiates a memory dump, the dump is encrypted and does not include administrative access to the private key.
  • Unbound CASP’s code build, signing, and deployment services run within IBM LinuxONE specialized Secure Image Build enclaves. These enclaves help rigidly enforce software review and attestation procedures, to frustrate potential malware, ransomware, and backdoor attackers. These defenses help assure that MPC is properly deployed without human interference. They also help accelerate testing and deployment of legitimate, authorized code updates if there’s ever an application security vulnerability requiring a quick fix. Secure Image Build solves two critical dilemmas: 1) proving the deployed software image is the right one and has not been modified or replaced by a privileged insider, and 2) proving the signed image is what it was supposed to be through the use of the secured source code manifest.
  • Exploitation of IBM Crypto Express Hardware Security Modules (HSMs) for the CASP cold backup key and CASP disaster recovery. IBM Crypto Express is one of the only commercially available FIPS 140–2 Level 4 certified HSM, meaning it meets or exceeds the most rigorous standards for tamper protection and response. It enables exceptional business continuity, which is mandatory for enterprise-grade financial institutions.
  • Only clients or their trustees control their assets — not Unbound Tech, nor IBM. Clients are issued special IBM smart card HSMs. During a trusted key ceremony, these smart cards collectively generate AES256 bit key parts that are securely transferred to the platform’s HSM and assembled into a master wrapping key inside an isolated HSM domain. Only the client retains control of their master wrapping key. HSM domains are highly isolated and protected by 360-degree envelope tamper detection and response.
  • Solutions can be deployed to the , on premises, or in a hybrid deployment, giving institutions and service providers full freedom to decide how and where they’d like to manage their digital asset platforms.

NFL Punish Baker Mayfield For His New Endorsement Deal? | Sports Takes & News

The NFL Players’ Association is worried about a new endorsement deal that Baker Mayfield signed this week. They are so worried that and not sign any similar deals since Mayfield’s new deal is with a company that makes CBD products. The reason being that the endorsement deal may be in violation of the current collective bargaining agreement with the league; leading many to wonder if the NFL will punish Baker Mayfield for signing the deal. The question is, should the NFL even bother?

Baker Mayfield announced last week that he was the , a company that makes cannabidiol (CBD) products. Under the collective bargaining agreement between the NFL and its union, players are prohibited from appearing in ads or endorsing companies that sell “alcoholic beverages, tobacco, or cannabinoid products.”

Here’s where this becomes a complex situation for the NFL and the NFLPA: CBD products are made from hemp or marijuana. Most CBD products contain THC, which is what gives its user a sense of being “high,” with marijuana-based CBD items giving a stronger high than those made from hemp, which has a lower THC content.

On Thursday, just two days after Mayfield signed his new deal with Beam public, the union sent out a email to its members that read: “player endorsements of cannabinoid products are not advised by the NFL Players Association,” citing the language in the collective bargaining agreement. Mayfield admitted that he was first concerned about the stigma attached to CBD products, but with Beam, making their CBD products THC-free, the Browns’ signal caller felt comfortable becoming both a user an ambassador for it.

By the end of the week there was no indication that the NFL was investigating Baker Mayfield or that any punishment was forthcoming; that does not mean that the league can’t or won’t render judgement at a later date. Mayfield does join a growing list of players that include DeAndre Hopkins, Ezekiel Elliott, Rob Gronkowski, Patrick Mahomes and Jalen Ramsey who are all brand ambassadors for CBD-based product — so perhaps the National Football League has turned the other way to some extent by allowing players to make money and enjoy the reported (but not fully proven) medical benefits such as pain relief that CBD products offer users. And a look at the standings see Baker Mayfield and the Browns at 4–1 heading into week 6, which might be a good indication that the company that he is endorsing is also helping his play on the field.

It does look like the NFL is willing to walk the line between what its players want, and what it needs to do as a business to keep the federal government off its back and out of its business. This is why the rules about CBD products are in the collective bargaining agreement, but the NFL is able to only use it when a player needs protection from himself; otherwise, it appears that the motto “smoke’em if you got’em” might be in effect for NFL players as sports continues to mirror mainstream society, and its acceptance of CBD products.

Noble’s eight takeaways from Manchester City vs Arsenal

Personally, when I watch football, I’m looking for structure in a game, whether a team wants to be defensive, or they want to press, keep possession, or be pragmatic.

We must all see some sort of structure in order to get results. Arsenal looks like a team that isn’t sure of who they are or who they would like to be. We have a lot of deadwood on our side and holes in the team were all not going to be fixed, but we should be playing better football. Even if Arteta wants us to be a defensive team, that’s fine but we should be creating chances and have a certain level of being lethal.

Despite giving us the best start to a Premier League campaign in seven-years (before kick-off last night), there are things the manager can be criticized for.

My eight takeaways

1. The back three which I see as a back five is limiting our attacking intent because last night I would see at least five Arsenal players in the opposition box as opposed to City’s three but just one pass would result in a dangerous shot at goal. Talk about failing to utilize your advantage.

2. The back five results in the midfield being stretched if the ball is not circulating to all parts of the pitch. And the primary role of our central midfielders is to try and win it back only to lose it easily because it’s hard to move the ball around.

3. The wide areas are not giving us much joy either whether it’s keeping and moving the ball, chances created, goals scored or quality crosses into the box.

4. We lacked a presence in the box, should a team with a good center forward struggle with this? Lacazette has struggled at times but despite this, he has scored in three consecutive games and has benched in the last two matches. Aubamayeng’s presence is not being felt at the moment and his goal tally so far is a clear indication that he isn’t being found by his teammates.

5. Ceballos is good with the ball and has an eye for a pass something he needs to be allowed to do more often, but he needs better starting positions in the middle of the park. Ceballos puts in a shift as he wants to win the ball back and start things from deep, however, his ability to do so is limited if the midfield is comprised of Xhaka and himself. We have to win the ball back to play it into dangerous areas, that said we won’t win matches this way with a two men central midfield. So I am grateful for Partey and Arteta must give us the 4–3–3 ASAP!

6. The Martinez aberration has divided opinion and I feel Leno’s efforts will not be appreciated much going forward. He will be blamed for things beyond his reach and sometimes over-glorified when things do go well. It’s going to be tough for Bernd Leno in the court of opinion presided by the Arsenal fans.

7. Most of our team played way below their usual levels and very few deserve special mention after the game, however, I will touch on Gabriel, and Thomas.

In Gabriel Magalhães we are blessed with a good player who won’t hide in games and that’s a good quality to have in a center back. I look forward to watching him progress, is safe to say when you hear opposition fans tell you that you will be lucky to hold onto him in years to come, it’s a massive endorsement of his talent.

Thomas Partey also had decent thirteen minutes, we all know he is a good signing. But his introduction gave me hope that he will adapt well to the Premier League and give us a three men midfield and give us much-needed stability. It’s the wide areas I’m concerned about the most, Nicolas Pepe and Willian must be giving the manager sleepless nights as much as they are giving the fans headaches.

8. BUKAYO SAKA IS SPECIAL. Need I say more?

There has been a surge in the number of UK children registering for free school meals, with an estimated 1 million pupils recently signing up for the first time, according to food poverty campaigners.

Best From Chicago Writers

To many ways my Wednesday was a typical “hump day.” I did my usual “rise and shine” about 6:00 a.m., got cleaned up, brewed some hot herbal tea, and mentally prepared to tackle a “to-do” list as long as a bride’s wedding gown train!

Worked on clients’ projects; prepared and published my 823rd blog post; struggled with computer glitches; and attempted to navigate my way through new content management system changes imposed by Blogger.

Hours in, I decided to take a much needed break. I kicked back, watched a little of the boob tube and then returned to my computer. At about 12:43 p.m. I received an unexpected email from the President of Chicago Writers Association that read the following:

“Dear Jennifer,

I am writing to you with the news that you have been selected as the recipient of CWA’s Spirit Award for 2020. I nominated you, and the Board unanimously endorsed your selection. We hope you will be able to join us for our virtual Book of the Year ceremony, which will be held via Zoom at 7 pm on Saturday, January 16.

I couldn’t think of a more deserving recipient.”

What? Who? I was elated… temporarily in disbelief! In fact, I had to read the email multiple times before it would fully “sink in.” This is a big deal to me, folks. And I am totally humbled and grateful for this prestigious award.

5 asteroids buzz by Earth TODAY, as NASA gears up for historic touchdown on asteroid Bennu

With just 73 days left in 2020, NASA has published an alert that not one, but five asteroids are passing by Earth today, as the agency’s Osiris-Rex spacecraft prepares to touch down on a space rock 200 million miles away.

The first three of the day’s five space rocks have mercifully passed the Earth by without incident, according to the Asteroid Watch Widget that tracks asteroids and comets that will make relatively close approaches to our planet.

2020 TJ6, measuring 10m in diameter or roughly half a bowling lane, passed the planet at a blistering speed of 40,824kph, but at a safe distance of 1.2 million km. The asteroid was followed by 2020 UX, the tiniest out of the five, which passed the Earth at 190,000km, and 2020 TD6, with a diameter of 7.4m or half the height of the Hollywood Sign.

Still to come are the 14-meter 2020 UK, with a diameter roughly the length of a semitrailer, which is expected to fly past at 6.2 million km.

Bringing up the rear will be the fastest space rock of the day, the one-meter-wide 2020 TF6, which will shoot by at a speed of 43,200kph, just 153,000km away — well within the range of the Moon which orbits the Earth at an average of 385,000km.

None of these compare with humanity’s own extreme close flyby expected to take place on Tuesday at the Bennu asteroid located over 200 million miles from Earth on that day.

NASA’s OSIRIS-REx will make its first attempt at collecting a sample of the space rock shortly before 2pm ET on Tuesday. The craft is expected to touch down for just a few seconds, long enough for its robotic arm to blast the surface with high pressure gas and vacuum up some of the asteroid’s space dust for analysis back here on Earth.

We’re cautiously optimistic that this will be the only time we touch the surface,” said Richard Burns, the OSIRIS-REx project manager at NASA’s Goddard Flight Center first on.

Ireland to put nation under ‘Europe’s strictest’ quarantine for six weeks amid record daily Covid-19 infections

Dublin has decided to impose a national lockdown for six weeks that has been described by the Irish government itself as the harshest in Europe — all to curb the spread of Covid-19 that has been topping record levels for days.

Under the newly announced measures that are scheduled to come into force starting midnight Wednesday, all non-essential retail stores will be shut down while restaurants and pubs will have to reduce their work to take-away services only.

The people in Ireland would also be barred from traveling more than five kilometers away from their homes. Yet, unlike many other European nations, Ireland does not plan to shut down schools. Essential services such as construction will be exempted from the lockdown as well. As will be hotels — but only if their rooms are rented by people working in any “essential” sectors.

“In the effort to suppress the virus, we’ve already introduced what is probably Europe’s strictest regime,” Prime Minister Micheal Martin said in a televised address on Monday.

The government has decided that the evidence of a potentially grave situation arising in the weeks ahead is now too strong.

The move comes just two weeks after Dublin dismissed a “surprise” call by the nation’s health authorities to introduce the highest — fifth — level of restrictions amid the growing infection numbers.

The nation has already topped its autumn record for daily new Covid-19 cases five times over the last nine days, although the numbers still remain lower that those recorded on April 10 when the infections surpassed 1,500 in a single day, according to Johns Hopkins University.

Ireland is no stranger to harsh measure when it comes to combating the epidemic. Back in spring, it also imposed one of the longest lockdowns in Europe and eased the restrictions at such a low pace that some hospitality venues have barely managed to reopen by the time the rising infection numbers forced the authorities to bring the curbs back.

To help its economy survive the epidemic, Dublin poured additional funds into coronavirus-related jobless payments and wage subsidies. A new budget approved last week involves one of the biggest financial aid packages in the nation’s history, including payments of up to € 5,000 ($5,884.50) per week for affected businesses. Still, the number of people seeking jobless payments has increased by 20 percent over just two weeks and reached 244,153 first on.

What’s new

To help you get better ROI from your marketing for the long term, we’re creating a new, more intelligent Google Analytics that builds on the foundation of the App + Web property.

The new Google Analytics is now the default experience for all new properties and is where we’re investing in future improvements.

You can access the new Google Analytics through the Google Analytics 4 property (formerly known as “App + Web properties”) which you can set up alongside your existing Analytics properties. This will allow you to start collecting data and benefit from the latest innovations as they become available while keeping your current implementation intact.

Google Analytics 4 properties were formerly known as “App + Web properties” during the beta period. Google Analytics 4 properties are available for all accounts, and are now the default when you create a new property, whether you plan to use it for a website, an app, or both.

Universal Analytics refers to the previous generation of Analytics. This was the default property type for websites prior to October 14, 2020.

If you use Google Analytics for Firebase for your app

Existing Google Analytics for Firebase customers are recommended to upgrade to Google Analytics 4 properties (formerly known as App + Web properties). When you upgrade to a Google Analytics 4 property, you can take advantage of the latest Analytics innovation and add your website data, without changing your existing Google Analytics for Firebase implementation.

How to structure your Analytics account

Learn how you can structure your Analytics account to measure a business of any size, from a small business with a single website to a large multinational business with multiple apps and websites. Small setups

For a business with one website, set up an Analytics account that contains a Google Analytics 4 property with

  • 1 web data stream

For a business with one mobile-app game, set up an Analytics account that contains a Google Analytics 4 property with

  • 1 app data stream for the Android game
  • 1 app data stream for the iOS game
  • 1 web data stream for the supporting website if there is one (e.g., marketing site)

Larger setups

To decide on the account structure for a larger business (e.g., multi-national, multi-brand), it’s helpful to ask the following questions.

Account

Think of an account as a collection of properties whose data is owned by a single legal entity and is governed by region-specific.

Is it important that the data from each region is owned by a distinct legal entity within that region?

  • Yes. Create multiple accounts, one for each region.
  • No. Create one account in the region that houses your company headquarters.

Property

A property represents the data for one logical user base (e.g., users of a single cross-platform application), and is the most granular level at which Analytics processes data. A property is also the level of the Analytics account hierarchy at which you create integrations with other products (e.g., Google Ads).

Is the data you collect related to a single logical user base? When you link Analytics to other products, do you want to share that entire body of data with each product?

  • Yes. Create one property.
  • No. Create a separate property for each logical user base.

Data stream

A data stream is the source of data from an app or website. A data stream is also the level at which you can control data-collection features via the Firebase SDK or the global site tag.

  • App streams: You can have one data stream for each combination of app-package name and platform.
  • Web stream: Create a single data stream for your site. Create a single web data stream per property.

Data filters and roll-ups

Do you need to filter data so that you can restrict specific data to specific members of your organization? Do you need to roll up data from multiple properties into a single property?

  • Yes. Google Analytics 4 properties do not currently support reporting views or Roll-Up Properties.
  • No. You’re all set.
